Code adopted
The city code says: "The current edition of the 2024 International Swimming Pool and Spa Code, is hereby adopted as the swimming pool code of the city as to all its terms and provisions and made a part of this Code as if repeated verbatim herein, with the qualifications, exceptions and additions as may, from time to time, be set out in this Code." The local amendments in Sec. 9-264 are two: the "Building and Standards Commission" replaces the "board of appeals," and appeals follow Sec. 9-18. We read the city code and did not find barrier heights restated there, so ask Development Services which barrier rules apply to your permit.

Building permit
The residential-code amendments list work that does not need a building permit, and that list includes "Prefabricated swimming pools that are less than 24 inches (610 mm) deep." The building-code list is narrower: it covers prefabricated pools under 24 inches deep that are not greater than 5,000 gallons and are installed entirely above ground. Its fence exemption reads "Fences, other than swimming pool barriers," so a pool barrier is not treated like an ordinary yard fence for that exemption. Those lists also say an exemption never authorizes work that violates the code or other laws. Floodplain and drainage reviews often apply when you add a pool; ask before you dig.

Site rules that often apply with a pool
Construction sites must follow Sec. 9-5, which includes temporary chain-link fencing where the building official requires it, silt protection, a metal roll-off container for debris, and portable sanitary facilities when the building official requires them. Parking of large RVs or boats in the front yard is a separate zoning rule (Sec. 24-515). Your deed restrictions or HOA may be stricter than the city code.
What happens if you don't
Building without a required permit falls under the building-code amendments, which say a person who violates them "shall be guilty of a misdemeanor for each day such violation continues, and as such shall be liable to a fine of not less than $50.00 nor more than $250.00 for each day's violation" (Sec. 9-17 and Sec. 9-321). We did not find a separate fine in Sec. 9-263 or Sec. 9-264, so for other pool-code violations the general penalty applies: a fine of up to $500, and each day counts as a new offense (Sec. 1-10; Texas Local Government Code Sec. 54.001).
