Start with "do I need a permit?"

The city's Development Services FAQ says a permit is required before beginning work, and that even painting and small cosmetic projects generally need a floodplain development permit. When in doubt, ask before you start. Homeowners may use a homeowner building permit only for homestead work in limited cases (roof repair or remodel) with insurance proof, per the same FAQ.

What the residential code lists as exempt

Sec. 9-321 amends the residential code's "Work exempt from permit" list. Exemptions "shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction." Examples on the residential list include one-story detached accessory structures (other than storm shelters) with a floor area not over 200 square feet, "Fences not over 8 feet (2438 mm) high," retaining walls not over 4 feet in height unless supporting a surcharge, "Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work," and "Prefabricated swimming pools that are less than 24 inches (610 mm) deep." Sidewalks and driveways appear as "(Reserved)" on that list, so do not assume they are exempt. Ask. Window replacement needs a permit per the city FAQ even when other finish work does not.

Building-code list and flood overlay

Sec. 9-17 has a parallel exempt list for the building code. It says building permits are not required for the listed work "Outside of Development Permits required by Section 9-20.8 and as defined by (15) Development at Section 9-70.5." If your project is a substantial improvement (cost over 365 days at or above 50 percent of market value), flood rules get stricter.

What happens if you don't

Building without a required permit is a misdemeanor under the building-code amendments. The code says a violator "shall be guilty of a misdemeanor for each day such violation continues, and as such shall be liable to a fine of not less than $50.00 nor more than $250.00 for each day's violation" (Sec. 9-17 and Sec. 9-321). Floodplain-division violations can bring a fine of not more than $500.00 per day for each violation (Sec. 9-70.21). The city can also stop work and withhold a certificate of occupancy.
